Unit: 7

National Green Tribunal Act 2010

The National Green Tribunal (NGT) Act of 2010 established the National Green Tribunal in India. The NGT is a judicial body that hears and decides cases related to environmental issues and violations of laws related to the protection of the environment. The NGT has the power to hear both civil and criminal cases, and its decisions are binding. The Act also established a National Green Appellate Tribunal, which hears appeals from decisions of the NGT. The NGT's jurisdiction extends to all of India and it is intended to provide a speedy and efficient way to resolve disputes related to the environment.

The Public Liability Insurance Act (PLIA) of 1991 is an Indian law that requires certain industrial and commercial establishments to have insurance coverage for liabilities that may arise from accidents or incidents that cause damage to the public or the environment.

Some important sections and clauses of the act are:

Section 3: This section lays down the requirement for operators of hazardous industries to obtain public liability insurance.

Section 4: This section provides for the constitution of an authority known as the Public Liability Insurance Corporation (PLIC) to administer the scheme of public liability insurance.

Section 5: This section lays down the duties and functions of the PLIC, which includes the management of the insurance fund, the settlement of claims, and the regulation of insurance companies.

Section 6: This section empowers the PLIC to prescribe the terms and conditions of the insurance policy and the premium to be charged.

Section 8: This section lays down the procedure for the settlement of claims, which includes the submission of a claim form and the provision of necessary documents and evidence.

Section 9: This section provides for the payment of compensation to the affected persons.

Section 10: This section lays down the powers of the PLIC to recover the amount of compensation from the operator of the hazardous industry.

Section 11: This section provides for the constitution of an appellate authority to hear appeals against the decisions of the PLIC.

Section 12: This section lays down the powers of the appellate authority to modify or set aside the decisions of the PLIC.

There haven't been any amendments to the Public Liability Insurance Act of 1991. However, laws and regulations are subject to change over time, so it is always a good idea to check for any recent amendments or updates to the Act.
